Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Laittern website and application (the "Service") operated by Laittern Limited ("Laittern", "we", "us").

By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy . If you do not agree, do not use the Service.

You must be old enough to consent to these Terms under the laws applicable to you. By using the Service you represent that you meet this age requirement.

User Accounts

You must provide accurate information when creating an account and keep your account credentials secure. You are solely responsible for all activity that occurs under your account. You may not share, sell, transfer, or otherwise provide access to your account to another person.

You must notify us promptly at official@laittern.com if you suspect unauthorised access to your account.

We reserve the right to reclaim or reassign usernames that violate these Terms or impersonate another person.

User Content

You retain ownership of content you submit to the Service, including journal entries, goals, comments, and life context notes ("User Content").

By submitting User Content, you grant Laittern a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit, and display your User Content as necessary to operate, maintain, improve, and provide the Service and features requested by users, including AI-assisted analysis.

You represent and warrant that your User Content does not violate any applicable law or infringe any third-party rights.

We do not sell your User Content and do not use User Content to train general-purpose AI models without user consent.

Content designated by a user as public may be displayed to other users, distributed through recommendation systems, indexed by search engines, and made available through publicly accessible pages of the Service.

Intellectual Property

The Service, including its design, software, branding, and original content created by Laittern, is owned by or licensed to Laittern Limited and is protected by applicable intellectual property laws.

Nothing in these Terms transfers ownership of Laittern's intellectual property to you. You may not copy, modify, distribute, reverse-engineer, or create derivative works from any part of the Service without our prior written consent.

Feedback and Suggestions

Any suggestions, feedback, ideas, feature requests, or recommendations you submit to Laittern may be used by Laittern without restriction, attribution, or compensation. By submitting feedback, you grant Laittern a perpetual, irrevocable, royalty-free licence to use such feedback for any purpose.

Virtual Items and Internal Economy

The Service includes virtual items, credits, rewards, achievements, and related digital features (collectively, "Virtual Items"), including the virtual credit system referred to as "crystals".

Virtual Items are provided solely as part of the Service experience and have no cash value, monetary value, or property rights.

Virtual Items may be used only within the Service for features, access, actions, rewards, or functionality made available by Laittern from time to time.

Virtual Items are not redeemable or exchangeable for cash, external goods, external services, or any compensation outside the Service.

Laittern may modify, reset, suspend, remove, or discontinue any Virtual Items or related features at any time, with or without notice.

Virtual Currency and Credits

Laittern may allow users to purchase virtual credits for use within the Service.

Crystals and any other virtual credits within the Service:

• Are not legal tender, electronic money, cryptocurrency, securities, or financial instruments of any kind.
• Have no cash value and cannot be exchanged for real-world currency.
• Cannot be redeemed, directly transferred to another account, withdrawn, or converted into any monetary value.
• All purchases of virtual credits are final and non-refundable once delivered, except where required by applicable consumer protection law.
• Laittern may modify, suspend, discontinue, reset, or adjust virtual credits at any time.
• If your account is terminated or suspended, associated virtual credits may be forfeited without compensation.
• Virtual credits are intended solely for platform functionality and are not intended as an investment, store of value, or financial product.
• Laittern may adjust, reverse, withhold, remove, or reclaim virtual credits obtained through abuse, manipulation, automated activity, fraud, or violations of these Terms.
• Virtual credits, rewards, or balances generated through user activity, engagement, likes, comments, reposts, recommendations, or other platform mechanics are determined by Laittern's systems and may be changed, reduced, reversed, withheld, or recalculated at any time.

Subscription and Payments

Certain features may require a paid subscription or the use of virtual credits. Pricing, plan features, and quotas are described within the Service and may be updated from time to time.

Continued use of the Service after a price or plan change constitutes acceptance of the updated terms, to the extent permitted by applicable law.

Refunds for paid subscriptions are subject to applicable consumer protection law and the terms stated at the time of purchase.

Payments may be processed by third-party payment processors. Laittern does not store full payment card details.

Unused virtual credits are not refundable or redeemable for cash except where required by applicable law.

Chargebacks, payment disputes, fraud, or payment abuse may result in suspension of access, reversal of virtual credits, or termination of the account.

Service Availability and Changes

We may modify, suspend, discontinue, replace, or remove any feature, functionality, content, virtual item, or aspect of the Service at any time, with or without notice.

We are not obligated to maintain any particular feature or functionality. Access to the Service may be interrupted due to maintenance, updates, technical issues, or circumstances beyond our control.

Prohibited Activities

You agree not to use the Service in ways that:

• Violate any applicable law or regulation.
• Infringe the intellectual property or other rights of any third party.
• Involve sending spam, unsolicited bulk messages, or commercial solicitations through the Service.
• Constitute fraud, phishing, scams, impersonation, or deceptive practices.
• Constitute harassment, bullying, threats, or abuse directed at any person.
• Involve uploading or distributing illegal content, including content that is defamatory, obscene, or violates applicable laws.
• Attempt to gain unauthorised access to any system, account, or data.
• Interfere with or degrade the performance or integrity of the Service.
• Use bots, crawlers, scripts, automated agents, or similar technologies to access, interact with, manipulate, or collect data from the Service except as expressly authorised by Laittern.
• Manipulate engagement, rankings, recommendations, virtual credits, rewards, or platform activity through fake accounts, coordinated abuse, bots, scripts, or other artificial methods.
• Create or use multiple, fake, or misleading accounts to manipulate activity, rewards, recommendations, or virtual credits.

Account Suspension and Termination

We may suspend, restrict, or terminate your access to the Service at any time, with or without notice, if:

• You violate these Terms or our policies.
• You engage in fraudulent, abusive, or harmful behaviour.
• Such action is necessary to protect the Service, its users, or third parties.
• Required by law or a legal order.

Laittern reserves the right to remove content or disable accounts at its sole discretion. Upon termination, your right to use the Service ceases immediately and associated virtual credits may be forfeited.

If you request deletion of your account, we may disable or remove public access to your profile, content, goals, comments, and other user-facing materials. However, certain records, logs, transaction histories, security records, and other information may be retained where necessary to comply with legal obligations, protect the Service, prevent fraud, resolve disputes, respond to lawful requests, or maintain system integrity.

Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied.

Laittern makes no warranties regarding:

• Availability or uninterrupted operation of the Service.
• Reliability or accuracy of any content or output.
• Fitness for a particular purpose.
• That the Service will be free from errors, viruses, or other harmful components.

AI-generated insights, advice, and analysis are for informational purposes only and are not professional medical, legal, financial, or therapeutic advice. Do not rely on them as a substitute for qualified professional judgment.

Limitation of Liability

To the maximum extent permitted by applicable law, Laittern and its affiliates, officers, employees, and licensors shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages.
• Lost profits or revenue.
• Loss of data or business interruption.
• Damages resulting from User Content or third-party content.
• Decisions made based on AI-generated content.

Where liability cannot be excluded by law, our total liability to you for any claim arising out of or relating to the Service shall not exceed the greater of (a) the amount you paid to us in the twelve months preceding the claim, or (b) HKD 100.

No Fiduciary Relationship

Nothing in these Terms or the Service creates a professional, fiduciary, advisory, therapeutic, employment, partnership, or agency relationship between Laittern and any user. You should not treat any output from the Service as professional medical, legal, financial, psychological, or therapeutic advice.

No Guarantee of Outcomes

Laittern does not guarantee the achievement of any goals, outcomes, results, or benefits suggested by the Service or generated through user activity. AI-generated content, goal suggestions, insights, and analysis are provided for informational and personal reflection purposes only.

Indemnification

You agree to indemnify, defend, and hold harmless Laittern, its affiliates, officers, employees, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of or access to the Service.
• Your User Content.
• Your violation of these Terms.
• Your violation of any applicable law or regulation.
• Your infringement of any third-party rights, including intellectual property or privacy rights.

Governing Law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-law principles. The courts of Hong Kong shall have exclusive jurisdiction to resolve any dispute arising out of these Terms or the Service, subject to mandatory consumer protections in your jurisdiction.

Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by updating the date at the top of this page and, where appropriate, by notifying you within the Service. Your continued use after changes take effect constitutes acceptance.
